Tool & Equipment Rental Agreement

1.1 Equipment Condition

• Provide tools/equipment in safe, working condition
• Ensure all safety guards and features are functional
• Provide operating manuals or instructions
• Disclose any known defects or limitations
• Ensure proper maintenance has been performed

1.2 Safety Information

• Provide safety warnings and usage instructions
• Recommend appropriate safety equipment (PPE)
• Demonstrate proper use if renter is unfamiliar
• Warn of any specific hazards or precautions

2.1 Competence & Experience

• Only rent tools/equipment you are qualified to use
• Read and follow all operating instructions
• Ask owner for demonstration if unfamiliar
• Do NOT attempt to use equipment beyond your skill level
• Obtain proper training if required (e.g., chainsaw certification)

2.2 Safety Requirements

• Use all safety guards and features
• Wear appropriate personal protective equipment (PPE)
• Follow all safety warnings and instructions
• Never bypass safety features
• Keep bystanders at safe distance
• Do NOT use while under influence of alcohol/drugs
• Stop use immediately if equipment malfunctions

2.3 Proper Use

• Use equipment only for its intended purpose
• Do NOT modify or alter equipment
• Do NOT exceed rated capacity or specifications
• Keep equipment clean and properly maintained during rental
• Store equipment securely when not in use

2.4 Prohibited Uses

• Do NOT use for commercial purposes (unless agreed)
• Do NOT lend to others without owner permission
• Do NOT remove serial numbers or identification
• Do NOT use in hazardous environments without proper equipment

3.1 Security Deposit

• Deposit amount set by owner (typically 25-50% of equipment value)
• Covers damages, loss, theft, excessive wear, cleaning
• Returned within 7 days if no issues
• Owner provides itemized list if deposit withheld

3.2 Rental Fees

• Daily/hourly rate agreed by both parties
• Late return fees apply after grace period
• Cleaning fees if returned excessively dirty
• Consumables (fuel, blades, bits) policy agreed in advance

4.1 Pre-Rental Inspection

• Photograph all sides of equipment
• Photo any existing damage or wear
• Photo serial numbers
• Document included accessories
• Test operation together if possible
• Both sign condition checklist

4.2 Return Inspection

• Repeat all photos from pickup
• Note any new damage
• Verify all accessories returned
• Check cleanliness
• Both sign return checklist

5.2 Theft or Loss

If equipment is stolen, renter must file police report and provide copy to owner within 24 hours. Renter liable for full replacement cost unless theft was due to break-in with no renter negligence.

6.1 Renter's Release

Renter releases owner from liability for injuries caused by equipment, even if due to equipment defect (unless owner knew of defect and failed to disclose).

6.2 Third-Party Injuries

Renter is liable for injuries to third parties caused by renter's use of equipment. Renter should maintain liability insurance.
