Elder Care Services Agreement

Required for all elder care and senior assistance services

Elder care involves serious risks including medical emergencies, falls, medication errors, and potential harm to vulnerable adults. This agreement requires your electronic signature.

If you are not comfortable with these risks, DO NOT use LoopHood for elder care services.

INTRODUCTION

This Elder Care Services Agreement applies to all users who offer or request elder care services through LoopHood, including companion care, senior assistance, personal care, and non-medical home care for adults 65+ or individuals with disabilities.

⚠️ NOT MEDICAL CARE

LoopHood does NOT facilitate medical care, nursing services, or licensed home health care. Providers offering medical services must be properly licensed and should NOT use LoopHood.

1. BACKGROUND CHECKS & SCREENING

Background Checks STRONGLY Recommended

While optional, background checks are HIGHLY recommended for elder care providers due to the vulnerability of seniors. However, background checks have limitations and do NOT guarantee safety.

LoopHood does NOT conduct background checks (Checkr provides optional checks)
Background checks may be incomplete, inaccurate, or outdated
A "Verified" badge does NOT mean someone is safe or qualified
You MUST still check references, verify experience, and use your judgment

2. CARE PROVIDER RESPONSIBILITIES

2.1 Required Certifications

Current CPR certification (adult & elderly)
First Aid certification
Fall prevention training (recommended)
Dementia care training (if applicable)
Provide proof of certifications upon request

2.2 Safety & Supervision

NEVER leave seniors unsupervised if they require supervision
Implement fall prevention measures
Monitor for signs of illness, distress, or medical emergencies
Follow all care plans and instructions from family/medical professionals
Maintain a safe environment (remove hazards, ensure adequate lighting)
Assist with mobility as needed (transfers, walking, wheelchair)

2.3 Medical Limitations

⚠️ PROHIBITED MEDICAL ACTIVITIES

Unless you are a licensed medical professional, you MAY NOT:

• Administer injections or IV medications
• Perform wound care requiring medical knowledge
• Make medical decisions or diagnoses
• Provide nursing care or medical treatments
• Change prescribed medication dosages

You MAY provide medication reminders and assist with self-administered medications as directed by family/doctor.

2.4 Emergency Response

Call 911 immediately for medical emergencies (falls, chest pain, breathing difficulty)
Notify family/emergency contacts immediately after calling 911
Know location of emergency medications (EpiPen, nitroglycerin, etc.)
Have emergency contact information readily accessible
Document all incidents in detail

2.5 Insurance & Licensing

Maintain elder care liability insurance ($1M+ recommended)
Comply with state home care licensing requirements (if applicable)
Report all income to tax authorities
Maintain accurate service records

3. FAMILY/GUARDIAN RESPONSIBILITIES

3.1 Thorough Vetting Required

YOU are solely responsible for vetting elder care providers. You MUST:

Contact at least THREE references and verify authenticity
Conduct thorough criminal background checks
Verify certifications (CPR, First Aid, training)
Conduct in-person interviews
Check for licensing if required in your state
Start with supervised trial periods
Trust your instincts - if something feels wrong, it probably is

3.2 Information You Must Provide

Complete medical history and current conditions
All medications with dosages and schedules
Physician and emergency contact information
Cognitive status and any dementia/Alzheimer's diagnosis
Mobility limitations and fall risk
Dietary restrictions and allergies
Emergency procedures and evacuation plans
Medical power of attorney information
Authorization for emergency medical treatment

3.3 Ongoing Monitoring

Make regular visits or check-ins
Review care logs and documentation
Watch for any signs of abuse, neglect, or exploitation
Maintain open communication with provider
Address concerns immediately
Terminate services immediately if safety is compromised

⚠️ ELDER ABUSE REPORTING

If you suspect elder abuse, neglect, or exploitation, report it immediately to:

• Local Adult Protective Services
• Law enforcement (911 for emergencies)
• National Elder Abuse Hotline: 1-800-677-1116
• LoopHood safety team: safety@loophood.app

4. INSURANCE REQUIREMENTS

LoopHood Provides NO Insurance

LoopHood does NOT provide insurance for elder care services. Both providers and families must maintain their own insurance.

4.1 Provider Insurance

Providers SHOULD carry:

Professional liability insurance ($1M-$2M recommended)
Coverage for elder care services
Workers' compensation if employing helpers

4.2 Family Insurance

Families should verify homeowner's/renter's insurance covers injuries to care providers in the home.

5. LIABILITY WAIVER

COMPREHENSIVE LIABILITY RELEASE

5.1 Assumption of Risk

You voluntarily assume ALL risks, including:

• Falls, injuries, illness, or death of senior
• Medical emergencies and medication errors
• Neglect, abuse, or exploitation
• Financial loss or theft
• Emotional harm or distress
• Property damage

5.2 Release of LoopHood

You RELEASE LoopHood from ALL liability related to elder care services, including provider negligence, abuse, medical emergencies, or any other claims.

5.3 Indemnification

You agree to INDEMNIFY LoopHood from any claims arising from elder care services, including wrongful death, injury, or abuse claims.

THIS WAIVER APPLIES EVEN IF LOOPHOOD IS NEGLIGENT.

6. ACCEPTANCE

Agreement & Acceptance

By checking the "I agree" box and proceeding with the booking, you acknowledge that you have read, understood, and voluntarily agreed to all terms in this Elder Care Services Agreement.

• LoopHood does NOT screen, vet, or supervise elder care providers
• Background checks are optional and have significant limitations
• Senior safety is YOUR responsibility, not LoopHood's
• If you're not comfortable with these risks, DO NOT use LoopHood
